This Agreement sets forth the legally binding terms and conditions for your use of the Site at http://philipdevries.com.

Refunds on downloaded, digital merchandise will not be given.
Refunds on orders which failed to provide access to purchased files may be given on the descretion of Philip de Vries Photography but not if it's been determined that a file was downloaded

Philip de Vries Photography grants buyer a non-exclusive perpetual personal-use license to download and copy the accompanying image(s) ("Media") subject to the following restrictions:
This license is for personal use only. Personal use means non-commercial use of the Media for display on personal websites and computers, or making image prints or video copies for personal use. The Media may not be used in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration. The Media may not be used in any form of advertising. The Media may not be resold, relicensed, or sub-licensed.
Title, ownership, and all rights now and in the future, of and for The Media remain exclusively with Philip de Vries Photography.
There are no warranties, express or implied. The Media are provided "as is".
Philip de Vries Photography will not be liable for any third party claims or incidental, consequential or other damages arising out of this license or buyer's use of The Media.
Philip de Vries Photography grants buyer a non-exclusive perpetual commercial-use license to download and copy the accompanying image(s) ("Media") subject to the following restrictions:
This license is for commercial use only. And is allowed for use in a professional setting. The Media may be altered for use on websites, advertising, printed media, and video usage for the purposes of financial gain without royalty payments. The Media itself may not be resold, relicensed, or sub-licensed.
Title, ownership, and all rights now and in the future, of and for The Media remain exclusively with Philip de Vries Photography.
There are no warranties, express or implied. The Media are provided "as is".
Philip de Vries Photography will not be liable for any third party claims or incidental, consequential or other damages arising out of this license or buyer's use of The Media.
We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Our Site may contain links to third-party sites that are not owned or controlled by Philip de Vries Photography.
Philip de Vries Photography has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.
This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of Ontario, Canada, without giving effect to any principles of conflicts of law.
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.
